We operate the website https://www.clikshot.pro (the 'Site'), the mobile application Clikshot.pro (the 'App'), as well as any other related products and services that refer or link to these legal terms (the 'Legal Terms') (collectively, the 'Services').

Clikshot.pro is an AI-powered professional headshot application available on web. Users upload selfie photos to generate studio-quality professional headshots for LinkedIn, and other professional platforms. Uploaded source photos are permanently deleted within 7 days; generated headshots remain available to download for 30 days.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ('you'), and Clikshot.pro, concerning your access to and use of the Services. You are responsible for what you post. By submitting content, you confirm it complies with our Prohibited Activities, waive moral rights where permitted by law, warrant it is original to you (or you have the necessary rights), and warrant it is not confidential.

We may remove or edit your Content at any time without notice if we consider it harmful or in breach of these Legal Terms, and may suspend or disable your account and report you to authorities.

3. User Representations

5. Purchases and Payment

We accept: Visa, Mastercard, American Express, Discover.

You agree to provide current, complete, and accurate purchase and account information, and to promptly update it. Sales tax will be added as required. We may change prices at any time. All payments shall be in AUD.

You authorise us to charge your chosen payment provider upon placing your order. We reserve the right to correct pricing errors even after payment has been requested or received, to refuse any order, and to limit or cancel quantities per person, household, or order, including orders placed under the same account, payment method, or billing/shipping address.

6. Subscriptions

Billing and Renewal: Your subscription will continue and automatically renew unless cancelled. You consent to recurring charges to your payment method without requiring prior approval for each charge, until you cancel. The billing cycle is monthly.

Fee Changes: We may change the subscription fee from time to time and will communicate any price changes in accordance with applicable law.

7. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make them available, or in connection with any commercial endeavour not specifically endorsed by us.

As a user, you agree not to, among other things: systematically retrieve data to build a database without permission; trick, defraud, or mislead us or other users; circumvent or interfere with security features; disparage or harm the Services; use information from the Services to harass or harm others; misuse support services or submit false abuse reports; use the Services unlawfully; frame or link to the Services without authorisation; upload viruses or spam; use bots, scripts, or data mining tools; remove copyright notices; impersonate another user; upload spyware or tracking mechanisms; disrupt or burden the Services; harass our staff; bypass access restrictions; copy or adapt the Services' software; reverse engineer the Services (except as permitted by law); use unauthorised scraping tools; use a buying/purchasing agent; collect usernames or emails for unsolicited email, or create accounts by automated means; compete with us using the Services; advertise or sell goods/services through the Services; sell or transfer your profile; use the platform fraudulently or deceptively; upload photos of anyone other than yourself without their explicit consent; use generated headshots to impersonate someone or misrepresent your identity; or upload images of minors.

8. User Generated Contributions

The Services may invite you to chat, contribute to, or participate in blogs, forums, and other functionality, and you may create and post content ('Contributions'). Contributions may be treated as non-confidential and non-proprietary. By creating Contributions, you represent and warrant, among other things, that they do not infringe third-party rights; you own or have the necessary rights and licences to them (including consent from any identifiable individuals depicted); they are not false, misleading, unsolicited advertising, obscene, harassing, or otherwise objectionable; they do not violate privacy or publicity rights, child protection laws, or any applicable law; and they do not include offensive content connected to race, national origin, gender, sexual preference, or physical handicap.

9. Contribution Licence

By posting Contributions, you automatically grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and licence to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt, and distribute such Contributions (including your image and voice) for any purpose, and to create derivative works, with the right to sublicence.

We do not assert ownership over your Contributions — you retain full ownership — but you are solely responsible for them and agree to exonerate us from liability related to them. We may edit, re-categorise, pre-screen, or delete Contributions at any time without notice, though we have no obligation to monitor them.

10. Mobile Application Licence

Use Licence

If you access the Services via the App, we grant a revocable, non-exclusive, non-transferable, limited right to install and use the App on your own devices. You shall not decompile or reverse engineer the App (except as permitted by law), modify it, violate applicable laws in connection with it, remove proprietary notices, use it for commercial purposes it wasn't designed for, make it available to multiple users/devices over a network, build a competing product, use it to send automated queries or unsolicited email, or use our proprietary information to build competing applications or devices.

Apple and Android Devices

If obtained via the Apple Store or Google Play, the App licence is limited and non-transferable and subject to the applicable App Distributor's terms of service. We, not the App Distributor, are responsible for maintenance and support. In the event of a warranty failure, the App Distributor may refund the purchase price but has no further warranty obligation. You represent that you are not located in a US-embargoed country and are not on any US government prohibited/restricted party list. You must comply with applicable third-party agreements when using the App. App Distributors are third-party beneficiaries of this section and may enforce it against you.

11. Third-Party Websites and Content

The Services may contain links to third-party websites and content. We do not investigate, monitor, or check these for accuracy or appropriateness, and are not responsible for them. Accessing third-party websites or content is at your own risk, and these Legal Terms no longer govern once you leave the Services. We do not endorse third-party products or services, and any purchases through third-party websites are exclusively between you and that third party.

We reserve the right (but not the obligation) to monitor the Services for violations, take legal action against violators including reporting to law enforcement, restrict or disable access to Contributions, remove excessive or burdensome files/content, and otherwise manage the Services to protect our rights and property.

Binding Arbitration: Unresolved disputes will be finally resolved by arbitration under the UNCITRAL Arbitration Rules, with one arbitrator, seated in Melbourne, Australia, in English, governed by Australian substantive law.

Restrictions: Arbitration is limited to the dispute between the individual parties — no class actions, class arbitration, or representative proceedings.

Exceptions: Disputes concerning intellectual property rights, allegations of theft, piracy, invasion of privacy, unauthorised use, or claims for injunctive relief are not subject to informal negotiation or arbitration and will be decided by a court of competent jurisdiction.
